The Council’s trading concessions are usually let for five years with an option for either party to terminate on three months prior written notice at any time. They are usually located in public parks or car parks.
When existing concessions become available, or if the Council identifies a new site they are offered through the Public Contracts Scotland website.
Parties interested in tendering for an existing concession site must register as a supplier on the Public Contracts Scotland website.
If you identify a new site for a concession, please read the questions and answers below before completing this online form.
Although the Council does not provide a site search service, there are links below to maps showing the Council’s ownership and adopted roads. Comments on the suitability of a site are not provided except in response to an online application for a new site. There is no appeals process.
New sites
If you identify a new site on Council owned land that is not part of the adopted highway, then please complete this online form. A non-refundable application fee of £165 per site is required to be paid. Online payment will be requested at the end of this form.

Back To TopSome Council owned land is subject to restrictions (for example Common Good which may require additional consultation with or approval by third parties which will inevitably increase the time taken to authorise the transaction with no guarantee that approval will be received. Another example is land protected by Fields in Trust (the National Playing Fields Association).
Back To TopIf your application is approved in principle, then the site will be offered to you for a term of five years (subject to an option for either party to terminate on three months’ prior written notice at any time) for an annual licence fee based on market rental values. The value of the site will vary depending upon the location and proposed use.
Back To TopThe Council’s approval will be sought and if authorised, a Council solicitor will be instructed to prepare a formal offer.
Back To TopIf heads of terms are not agreed then the site may be offered on the open market. In that event, offers will be invited through Public Contracts Scotland and you will have the opportunity to bid alongside third parties. The Council is not obliged to accept the highest or any offer.

The Council is not obliged to accept the highest or any offer.
Back To TopA Council solicitor will issue a formal offer to you for a term of five years at the annual licence fee that you have proposed exclusive of VAT. The licence to occupy may be terminated at any time by either party on three months’ prior written notice. It is recommended that you seek your own legal advice on the terms of the offer.

Back To TopNo. Each site is let to a single business on a full-time basis only. The annual charge will not be reduced if you choose to trade for fewer hours than are possible.

No, for an ice-cream concession the annual licence fee (rent) is attributed to the period 1st April to 30th September each year. There is no charge for the period 1st October to 31st March, though you may trade during that period.
For example, if you offer an annual licence fee of say £12,000, it will be charged in equal monthly instalments in advance of £2,000 on 1st April, 1st May, 1st June, 1st July, 1st August and 1st September.
If your licence commences after 1st April, then the annual fee for the first year will be apportioned from the date of entry on the basis that the annual figure is for the period 1st April to 30th September.
In this example, if your licence commenced on 1st May, you would pay £2,000 on 1st May and the same on the first day of each subsequent month until your last payment for that year being on 1st September.
Payments would commence again on 1st April of the following year.

- A site’s suitability will be considered in terms of its risk from flooding and coastal erosion
*Beaches with acceptable water quality may be at risk from water pollution after heavy rainfall.
Applications are considered on their merits and may be declined due to issues other than those listed above. Please read the Designated Bathing Beaches list before applying.
