The Environmental Information (Scotland) Regulations 2004 set out enforceable regulations that govern the public’s right to access the environmental information we hold.
The requirements are slightly different to those of the Freedom of Information (Scotland) Act 2002. One main difference is that from 1 April 2012 information that costs over £100 to provide to the applicant, will be charged for, in accordance to our Schedule of Costs. Environmental information covered by the regulations includes the state of:
- the air
- atmosphere
- water
- soil
- land
- landscape
- as well as factors affecting the above elements such as substances, energy, noise, radiation or waste, emissions, discharges into the environment
